Trading as “Cured Cravings”

These Terms and Conditions apply to Cured Cravings Pty Ltd ACN 68 691 807 771 ABN 98 921 094 686 trading as “Cured Cravings”.

References in this document to “Cured Cravings Pty Ltd”, “Cured Cravings”, “we”, “us”, or “the Supplier” refer to the same legal entity.

Interpretation

In this document, the defined terms shall have the following interpretations:

“Customer” refers to any person or company that acquires goods and/or services from the Supplier.

“Supplier” refers to Cured Cravings Pty Ltd.

“Terms and Conditions” signifies the terms and conditions outlined within this document and/or the Supplier’s quote or invoice, if applicable.

Acceptance of Terms

These Terms and Conditions apply to all agreements for the supply of goods and services by the Supplier to the Customer and supersede any other documents or communications from the Customer.

Any amendments to these Terms and Conditions must be agreed in writing by the Supplier.

Ordering, Payment and Pricing

Unless expressly stated on the Supplier’s website, pricing and delivery terms will be detailed in the Supplier’s quotation. Where services have been quoted, payment by the Customer is structured as follows:

A deposit agreed between the Supplier and the Customer upon acceptance of the quote.

The remaining balance of the quoted services is payable:

two (2) weeks before the agreed order date for grazing tables and the charcuterie cart

seven (7) days before the agreed order date for grazing boxes and all other catering

The Supplier may vary pricing or introduce promotions at any time without notice. Once an order has been placed and accepted, the quoted price will not change for that order. The Supplier will not provide refunds if prices are reduced after an order has been placed.

Obligations

Customer Obligations

To allow the Supplier to fulfil its obligations, the Customer must:

Comply with the payment terms outlined in these Terms and Conditions

Provide accurate delivery details and a valid contact person for delivery

Supplier Obligations

The Supplier will perform the services with reasonable skill and care.

If either party is unable to fulfil its obligations due to circumstances beyond its reasonable control (including extreme weather, epidemics or pandemics, strikes, accidents, war, fire, machinery failure, or raw material shortages), the affected party will be granted a reasonable extension of time.

Limitation of Liability

To the fullest extent permitted by law, the Supplier shall not be liable to the Customer or any third party for:

Any indirect, incidental, special, or consequential loss or damage

Loss of profit, revenue, business opportunity, or anticipated savings arising from or in connection with the services or these Terms and Conditions

The Supplier’s total aggregate liability is limited to the total value of the Customer’s order.

Allergies and Dietary Restrictions

The Customer must notify the Supplier of any allergies or dietary restrictions at the time of ordering. This may be included in the order form or communicated via email to info@curedcravings.com.au

The Customer acknowledges and accepts that while reasonable efforts are made to accommodate dietary requirements, food is prepared in an environment that may contain allergens including, but not limited to, nuts, milk, eggs, fish, tree nuts, wheat, soybeans, and sesame. The Supplier cannot guarantee allergen-free products.

The Customer agrees to release and indemnify the Supplier from liability arising from undisclosed allergies or dietary requirements.

Consumption and Food Safety

All food supplied must be consumed within three (3) hours of delivery or pickup. Consumption after this period is at the Customer’s own risk.

The Customer is responsible for appropriate food handling, including keeping food out of direct sunlight and ensuring it is not left unattended. The Supplier accepts no liability for illness or injury caused by failure to adhere to these guidelines.

Cancellation Policy

Cancellations made more than seven (7) days before the order date may be refunded or rescheduled, excluding the non-refundable deposit

Cancellations made within seven (7) days of the order date are non-refundable due to the perishable nature of goods

Any offer of credit is at the Supplier’s sole discretion.

Damage or Unreturned Equipment

The Customer is responsible for any loss or damage to equipment supplied by the Supplier. Where items are damaged, chipped, dented, or not returned, the Customer agrees to pay replacement or repair fees as determined by the Supplier.

Intellectual Property

All website content, including images, text, designs, graphics, and trademarks, is the intellectual property of Cured Cravings Pty Ltd, unless otherwise stated.

Content may not be reproduced, distributed, modified, or republished without prior written consent from the Supplier, except for personal, non-commercial use.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
